Article 1 - Purpose

The present conditions govern the sale by the company Colonval Concept Street deportees 37, 6120 Jamioulx linens and accessories for professionals and individuals.

Article 2 - Price

The prices of our products are indicated in euros all taxes (VAT and other taxes applicable on the date of the order), unless otherwise indicated and except expenses of treatment and forwarding.

For orders to countries other than Belgium you are the importer of the products concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights are not within the purview of the Colonval Concept company. They will be at your expense and are your responsibility both in terms of returns and payments to the authorities and bodies in your country. We advise you about these issues with your local authorities.

All orders whatever their origin are payable in euros.

The Colonval Concept reserves the right to change prices at any time but the products will be charged on the basis of tariff in force at the time of confirmation of the order and subject to availability.

The products remain the property of the Concept Colonval company until full payment.

Warning: once you take physical possession of the ordered products, the risk of loss or damage of products are transferred.

Contractual information is presented in French and will be confirmed at the latest at the time of checkout.

The Colonval Concept reserves the right not to accept payment, and not to confirm an order for any reason, particularly in the event of supply problems, or in case of difficulties with the order received.

Article 4 - Validation of your order

All orders contained on the website www.colonvalconcept.be implies acceptance of these Terms. Any confirmation of order implies your full acceptance of these terms of sale without exception or reservation.

Article 5 - Payment

The speed of the card is performed at the time of shipment of the order. If split deliveries, only the products shipped are debited.

Article 6 - Withdrawal

Pursuant to Article L.121-21 of the Consumer Code, you have a 14-day withdrawal period from the receipt of your products to exercise your right of withdrawal without any reasons or to pay a penalty.

The returns should be in their original condition and complete (packaging, accessories, note). In this context, you are liable. Damage to the product at that time may be such as to defeat the right of withdrawal.

The return costs are your responsibility.

Upon exercise of the right of withdrawal, the Concept Colonval company will refund the sums paid within 14 days of the notification of your application and via the same means of payment used when ordering.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:

The provision of fully executed before the end of the withdrawal period and services whose performance began after prior express consent of the consumer and expressly waiving his right of withdrawal.
The supply of goods or services whose price depends on fluctuations in the financial market beyond the control of the trader and which may occur during the withdrawal period.
The supply of goods made to the consumer's specifications or clearly personalized.
The supply of goods liable to deteriorate or expire rapidly.
The supply of goods which were unsealed by the consumer after delivery and can not be returned for hygiene or health protection reasons.
The supply of goods which, having been delivered and by their nature, are mixed inseparably with other items;
The supply of alcoholic beverages whose delivery is delayed beyond thirty days and the value agreed to conclude the contract depends on market fluctuations outside the control of the professional.
Providing audio or video recordings or computer software that have been unsealed by the consumer after delivery.
The supply of a newspaper, periodical or magazine, except for the subscription contracts in these publications.
Transactions concluded at a public auction.
The supply of digital content not supplied on a tangible medium whose implementation began after prior express consent of the consumer and expressly waiving his right of withdrawal.

Article 7 Availability

Our products are available as they are visible on the website and in the www.colonvalconcept.be stocks. For products not stocked, our offers are valid subject to availability from our suppliers.
In case of unavailability of product after placing your order we will notify you by mail. Your order will be canceled and no bank debit will be made.

In addition, the www.colonvalconcept.be website is not intended to sell its products in large quantities. Therefore the Colonval Concept reserves the right to refuse orders of 50 identical items.

Article 8 - Delivery

The products are delivered to the shipping address provided during the order process, within the time specified on the order confirmation page.

In case of delayed shipment, an email will be sent to inform you of a possible impact on the delivery which you indicated.

As required by law, in case of late delivery, you get the opportunity to cancel the order in the terms and conditions defined in Article L 138-2 of the Consumer Code. If meanwhile you receive the product we issue a refund and the cost of transport in terms of Article L 138-3 of the Consumer Code.

If deliveries by a carrier, the Concept Colonval company can be held responsible for late delivery due exclusively to the unavailability of the customer after several appointments proposals.

Article 9 - Warranty

All our products have the legal guarantee of compliance and the guarantee against hidden defects, provided by Article 1641 of the Civil Code. In case of non-compliance of a product sold, it can be returned, exchanged or refunded.

All claims, requests for exchange or refund must be made by mail, phone or post within 30 days of delivery.

Products must be returned in the condition in which you received them with all the elements (accessories, packaging, manuals ...). The shipping costs will be reimbursed based on the rate charged and the cost of return will be refunded upon presentation of receipts.

The provisions of this Article shall not prevent you from enjoying the right of withdrawal under Article 6.

Article 10 - Liability

The products are conform to the Belgian legislation. Responsibility for Colonval Concept company can not be held liable for non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities the possibilities of import or use of products or services you plan to order.

In addition, the Concept Colonval company can not be held liable for damages resulting from misuse of the product purchased.

Finally responsibility for Colonval Concept company can not be held for any inconvenience or damage arising from the use of the Internet, including a break in service, external intrusion or presence of computer viruses.

Article 11 - Applicable law in case of disputes

The language of this contract is French. These terms and conditions are subject to Belgian law. In case of dispute, the French courts shall have exclusive jurisdiction.

Article 12 - Intellectual Property

All elements of the site www.colonvalconcept.be are and remain the exclusive intellectual property of the company Colonval Concept. No one is allowed to reproduce, use, repost, or use for any purpose whatsoever, even partially, elements of the site they are software, visual or sound.
